I DON’T LIKE THE TERMS IN THE CONTRACT CAN I CHANGE THEM?
Yes, just as Main Contractors and their Developer Clients amend the standard terms of the contract in many cases unfavourably against sub-contractors, you are equally justified in requesting amendments to the contract.
Of course, the difficult part is negotiating with the Main Contractor to find a mutual acceptable common position, and this is where the FRESH JCT can help you.
IS IT POSSIBLE TO GET PAID FOR MATERIALS OFF SITE?
This is probably one of the more difficult clauses to negotiate as Main Contractors and Developers are always reluctant to make payment for material off site.
Having said that with a reasoned argument professionally presented and the use of vesting certificates to overcome the Main Contractors main objection of security of goods it is perfectly possible to obtain payment for materials off-site.

DO I HAVE TO ACCEPT RETENTION DEDUCTIONS FROM MY PAYMENTS?
No, you do not have to, but you must negotiate with the Main Contractor before signing any contract.
Main Contractors will always try and insist upon retention deductions using the mistaken argument that this gives them the comfort you will address any defects or snags.
