What are JCT & NEC Contracts?
Do you know what you are signing ?
If you wish to be a subcontractor or specialist supplier to the UK Construction Industry you will have been confronted with a substantial subcontract document usually a JCT or NEC Contract Document.
The many different forms of JCT documents are produced by the Joint Contract Tribunal whilst the NEC Contract or New Engineering Contracts are created by the Institute of Civil Engineers. Both contracts were designed with the good intentions to provide a fair and equitable contract between the Main Contractor and subcontractor.
Even unamended JCT or NEC contracts are complex and lengthy legal documents. Invariably amended versions contain pitfalls and onerous clauses putting subcontractors at risk.
Under no circumstances should subcontractors be signing and entering into these contracts without fully evaluating the risks involved.
